Powers of Attorney

Making provision for someone to deal with your financial affairs and health and personal welfare decisions can be a frightening prospect.

Our team has many years’ experience and empathy when acting for people in vulnerable positions, whether in relation to applying to the Court of Protection or creating powers of attorney.

For individuals we can help with:

  • Lasting Powers of Attorney – these are important legal documents where you can appoint individuals to make decisions on your behalf if you are unable to do so as you have lost capacity to manage your affairs. There are documents which deal separately with financial affairs and personal welfare. We can advise on who to appoint, any instructions and preferences you may have, act as certificate providers for you and arrange for the documents to be registered with the Office of the Public Guardian. We treat difficult questions that need to be considered with compassion and efficiency.

For our business clients:

  • General Powers of Attorney to deal separately with business interests and personal finances.
  • Our specialist team will work in tandem with the business and corporate team.

Court of Protection

There are instances where a person may lose capacity and not have the necessary Power of Attorney in place for their loved ones to assist in managing their affairs. We understand how difficult this is for their family and can assist with an application to the Court of Protection for the appointment of a deputy.

A deputy is appointed by the Court to make decisions for someone who is unable to make them due to a lack of capacity. These can be decisions regarding their property and finances or health and welfare. The application can be extremely complex and we can provide support and assistance to make the initial application and ongoing support in your role as a deputy. We understand this can be a challenging and emotional time and will support and guide you throughout.
