How much road traffic accident compensation can I claim?

You are entitled to make a claim that compensates you for the pain and suffering and loss of amenity (being unable to do the things you used to do) that you have experienced, both now and in the future. These are known as general damages.

You can also claim for losses that you can quantify, such as loss of earnings, the expense of travelling to medical appointments, therapy and care requirements, modifications to your home and other financial losses. These are referred to as special damages.

The amount you can claim will depend on the severity of your injuries and how long they will affect you. Our team are very experienced in dealing with personal injury claims and will be able to discuss in general terms with you how much you might expect to receive.

If you ask us to represent you in your claim, we will instruct medical experts to prepare reports on your injuries which will help us assess the amount that could be payable.

How long does a road traffic accident claim take?

This will depend on a number of factors, including how serious your accident was, whether the other party admits liability and how long your injuries are likely to last. If your injuries are ongoing, then you may be advised not to settle too quickly to see what your prognosis is likely to be.

Can I make a no win, no fee road traffic accident claim?

We can usually take your case on a no win, no fee basis also referred to as a conditional fee agreement. This would mean that you would not have to pay anything to bring your claim, and fees would only be payable if you are successful. We also offer no win, no fee fatal road traffic accident claims, which will be brought on behalf of the deceased’s estate.

What is the time limit for road traffic accident claims?

The time limit for bringing a claim in a road traffic accident case is generally three years from the date of the accident. Where your injuries were not initially apparent, you will have three years from the date on which you discovered them.

In respect of children who are injured in a road traffic accident, they can bring a claim for up to three years after their 18th birthday. Before they are 18 years of age, their parent or guardian can initiate a claim on their behalf.

It is generally advisable to commence a claim as soon as possible, so that evidence can be gathered while the incident is fresh in everyone’s minds and medical experts can examine your injuries and record their effect on you.

Can I make a road traffic accident claim if I was partly at fault?

If you believe that you may have been partly to blame for the accident, you may still be entitled to make a claim for compensation.

Your part in the accident will be referred to as contributory negligence, and a deduction may be made from your compensation in respect of this. For example, if you were held to be 25% responsible, you could be entitled to receive 75% of what you might have received had you not been at fault.
